Article 1 General

1.1 All agreements concluded by EQfit Academy BV are governed by Dutch law.

1.2 These conditions apply to all deliveries of products and services by EQfit Academy BV to clients and / or principal regarding research, training and services and all related agreements and all related actions.

1.3 Deviating terms and conditions only apply insofar as they have been accepted in writing by EQfit Academy BV and only apply to the relevant agreement.

1.4 Prior to the formation of an agreement, a copy of the general terms and conditions will be made available to the client and/or clients at www.eqfit.nl. By agreeing to or paying for the EQfit Academy BV services, the client and/or principal declares to accept the terms and conditions and also to be aware of these terms and conditions.

1.5 If one or more of the provisions in these general terms and conditions are invalid or may be annulled, the remaining provisions of these general terms and conditions shall continue to apply in full.

1.6 EQfit Academy BV reserves the right to change the terms and conditions.

Article 2 Contract

2.1 EQfit Academy BV offers training, education (partnership), team development and other services. Overviews of these can be found on the website and on other documentation.

2.2 Clients under the age of 18 must have written permission from their parents.

2.3 When training minors, we also want the parents to be open to any training.

2.4 The management reserves the right to terminate an EQfit Academy BV assignment with the client/principal without giving reasons, for example in case of violation of these terms and conditions or misconduct, without any refund of paid amounts being due.

2.5 By agreeing to the services of EQfit Academy BV, through payment of amounts due, and attending the first session/lesson day, the client/client/course participant is liable to pay for the complete service and interim termination will not provide a refund of amounts paid. 2.6 The client declares to cancel an appointment more than 24 hours in advance, otherwise the training will be charged extra.

Article 3 Termination of EQfit Services

3.1 Temporary termination of an EQfit Academy BV service (e.g. because of holidays/circumstances) is only possible in consultation with the EQfit Academy trainer.

3.2 Longer-term impediments to not being able to follow the course or assignment due to illness or accident can be reported to the EQfit Academy trainer with a request to suspend these services.

3.3 The EQfit Academy BV services are personal and therefore not transferable to others with the exception of EQfit Academy Family.

Article 4 Services

4.1 EQfit Academy BV will make every effort to perform the agreed services to the best of its knowledge and ability and in accordance with the applicable laws and regulations.

4.2 Changes and/or additions to the services to be provided can only be agreed in writing.

Article 5 Payments

5.1 Client/client/course participant is obliged to pay the agreed payments to EQfit Academy BV within the payment term.

5.2 Fees that are due can be adjusted unilaterally by EQfit Academy BV, depending on a.o. cost price factors.

5.3 If the payment obligation is not met, we reserve the right to terminate the EQfit Academy BV services until the amount due is paid.

5.4 If we are forced to hand over the claim for collection to a bailiff, the extrajudicial costs, being 15% of the amount due at that time, with a minimum of € 40.00, will be recovered. The EQfit Academy BV services will be terminated by EQfit Academy BV on this basis.

5.5 The payment term of the invoice for the delivered products and services of EQfit BV is 7 days after the invoice date, and the amount must be transferred to the account number specified on the invoice. Also, an upfront payment can be requested by EQfit Academy BV.

Article 6 Order/Instruction Rules

6.1 It is not allowed to use drugs, alcohol or smoking articles during the training/trajectory/assignment or other services of EQfit Academy BV. Use of such means will result in immediate termination of EQfit Academy BV services.

6.2 You must comply with the instructions given by EQfit Academy BV.

6.3 In case of violation of these instructions, EQfit Academy BV is entitled to terminate the EQfit Academy BV services immediately without refund.

Article 7 Complaints and Liability

7.1 Where there is a complaint by the client/client/course participant, the payment obligation shall not be suspended. The client/principal/course participant must notify EQfit Academy BV in writing of a complaint as soon as possible.

7.2 EQfit Academy BV is not liable for damage, loss, theft or loss of personal property.

7.3 The client/client/course participant is aware that practicing sport involves risks and that he/she assumes responsibility for any (consequential) damage that may occur as a result of practicing sport. Also, the client will indemnify EQfit Academy BV from interference of third parties in this matter.

7.4 EQfit Academy BV is not liable for any indirect damage, of whatever nature, related to the execution of our work.

7.5. The client declares to be aware of the fact that results are not guaranteed and that this also depends on personal commitment.

Article 8 Health certificate

8.1 The client/customer/course participant declares by agreeing to the EQfit Academy BV services not to be aware of any illness or physical discomfort which would make participation in the course/assignment medically irresponsible, and will always report physical details and/or use of medication to the EQfit Academy trainer concerned before the start of the course/assignment.

Article 9 Opening hours and locations

9.1 EQfit Academy BV reserves the right to change days/times and/or locations.

9.2 On official and recognized holidays and during vacations EQfit Academy BV is entitled to be closed.

Article 10 Secrecy and Privacy

10.1 EQfit Academy BV will treat any information obtained through trajectory/assignment confidentially and will ensure that this information is not viewed by third parties, unless explicit written permission has been granted.

10.2 EQfit Academy BV will keep a file of all its client/client whom it examines as part of an intervention. All personal data, medical or otherwise, which are part of these records are subject to the statutory privacy regulations.

10.3 EQfit Academy makes every effort to protect the personal data of its clients and/or customers.

Article 11 Quality guarantee (for private clients only)

11.1 EQfit Academy offers a quality guarantee. If the client is not satisfied immediately after the first session and reports this to the trainer, the amount of the remaining sessions will be refunded within 14 days. Thus, the choice to end the course can only be made immediately after the first session.

Cancellation policy of EQfit Academy

12.1 Training courses can be cancelled free of charge up to 6 weeks before commencement.

12.2 If the reservation for the training course is cancelled after this time, the following rates will be charged: – 60% of the total reservation value for cancellation within 4 weeks before the start date. – 70% of the total reservation value if cancelled within 3 weeks before the start date. – 80% of the total reservation value if cancelled within 2 weeks before the start date. – 100% of the total reservation value if cancelled within 1 week before the start date.
